What is EB-2 NIW
EB-2 NIW or National Interest Waiver is a type of green card that is granted to individuals that can have a positive impact on the United States society, economy or cultural scene. Because of the positive impact of that important mission, it waives the typical requirement for a job offer.
To qualify you must:
✅ Prove your are an advanced degree holder. This means you obtained a Master's or PhD in your discipline, or have a bachelor plus five years of post-graduation experience. Alternatively, there is a more complex route for "exceptional ability" persons without advanced degree.
✅ You have a proposed endeavor (aka professional mission) that has substantial merit and national importance. In other words, you can describe to USCIS a mission for your stay in the USA that will bring benefits for the country.
✅ You are well positioned to advance that proposed endeavor: In other words, you are the right person for the job. Here you show evidence of impact in your field, such as relevant projects you were a part of, publications you authored, awards, press recognition, etc.
Working with a lawyer vs Do-It-Yourself
You can apply for this immigration benefit using an immigration attorney, or you can craft your own case. Of course, each option has pros and cons, and you should ultimately decide based on factors such as:
- Your desired timeline
- Your financial status
- Your willingness to learn the process and put in the time and effort
